Terms and Conditions of Participation

Please read this document carefully before registering, as it has direct legal consequences and governs the terms of participation between the organiser and the participant.

The Tour de Suisse Explorer (hereinafter also referred to as the “Event”) is organised by Verein Tour de Suisse, Rotbuchstrasse 46, 8037 Zurich (hereinafter referred to as the “Organiser”).

  1. Scope of Application of the Terms and Conditions of Participation: These Terms and Conditions of Participation govern the legal relationship established between a participant and the Organiser. The contract is concluded when the Organiser sends the interested person an email confirming registration for the Event.
  2. Eligibility to Participate: Participation is open to persons aged 18 and over. No licence or club membership is required to participate in the TdS Explorer. Participants under the age of 18 are not entitled to any rewards or competition prizes.
  3. Compliance with Mandatory Provisions: The applicable mandatory provisions for participation in the TdS Explorer must be complied with. Participants are obliged to comply with all applicable mandatory provisions, in particular with regard to measures relating to safety and the protection of participants’ health.
  4. Participation at Own Responsibility and Risk: Participation in the Event is at the participant’s own responsibility and risk. The Organiser and its partners assume no liability for theft, accidents or illness. All participants are responsible for starting in a well-trained condition and in good physical health and for checking external conditions such as weather and route conditions. Participation is at one’s own risk and responsibility. Where appropriate, the participating person should (in case of uncertainty) have the medical requirements examined and confirmed by a specialist physician. The participating person also confirms awareness that they may withdraw from participation at any time.
  5. Insurance: Insurance against accident, illness or theft, as well as personal liability insurance, is the responsibility of each participant. By registering, participants release the Organiser and its partners, their auxiliary persons and the land and road owners along the route and event area from all liability claims and confirm that they are sufficiently insured against illness, accident and liability.
  6. Responsibility for Equipment: The participating person hereby confirms that (i) the bicycle complies with the legal requirements applicable in Switzerland for riding on public roads and (ii) that they wear a helmet at all times during the ride (we recommend at least the EN 1078 standard).
  7. Swiss Road Traffic Act: The Swiss Road Traffic Act applies at all times. The participating person hereby acknowledges and confirms that the TdS Explorer takes place on public roads that are not closed to traffic. Rules must be observed such as not crossing guiding or safety lines, stopping when required by signage, and granting right of way to authorised road users.
  8. Determination of Competition Prize Winners: The winners of the competition prizes will be determined after completion of the TdS Explorer in September. The competition prizes will be raffled among all participants of the TdS Explorer who have visited the required checkpoints by September 2025. These persons will be informed of their win by email by the end of November 2025 and requested to contact the Organiser by email. Winners must respond by email within 96 hours after being contacted by the Organiser; otherwise, the prize will be reallocated and the entitlement will lapse. It is the responsibility of the winners to ensure that they can properly receive the Organiser’s email (in particular with regard to spam/junk mail settings, etc.). Cash payment in lieu of the prize is not possible. Winners are responsible for any taxes that may be incurred. Legal recourse is excluded.
  9. Claiming Finisher Prizes / Rewards: Participants must actively claim the various finisher prizes/rewards and complete the relevant form after completing the challenge. The Organiser and its partners assume no liability for defects in material prizes. There is no entitlement to cash payment in lieu of material prizes, nor to exchange, modification or transfer to another person. The Organiser or its partners are entitled at any time to offer equivalent substitute prizes. If the contact details provided are incorrect (e.g. invalid email address), the Organiser and its partners are not obliged to identify correct addresses. Any disadvantages resulting from incorrect contact details shall be borne by the participating person. Each person is entitled to only one finisher prize.
  10. Collection and Processing of Data: For the purpose of the proper organisation of the Event, the Organiser collects corresponding personal data. The handling of such data is governed by the Organiser’s privacy policy, which applies to the Event.
  11. Cancellation of the TdS Explorer: If the TdS Explorer cannot be carried out for reasons beyond the control of the Organiser and its partners and therefore contractual services cannot be provided or cannot be provided in accordance with the contract, the Organiser and its partners shall not be liable for damages towards participants. The same applies in the event of termination of the TdS Explorer for reasons beyond the control of the Organisers and their partners.
  12. Offers by Event Partners (Commercial Third Parties): a.) The execution of offers by partners of the Organiser is the sole responsibility of the respective partners. The Organiser acts solely as an intermediary between customer and partner and excludes any liability. The Organiser’s services are limited to collecting, describing and arranging such offers. b.) Any contract relating to the booking and execution of a partner’s offer is concluded directly between the customer and the respective partner. The fulfilment of the booked service does not constitute an obligation of the Organiser. The Organiser acts solely as an intermediary.
  13. Exclusion from the Event: The Organiser reserves the right to exclude participants from the Event at any time if they behave irresponsibly or act contrary to the Organiser’s instructions. Possible reasons (non-exhaustive list) include: inadequate equipment, alcohol consumption, drug use, doping, injuries, environmental pollution or endangerment of oneself or others.
  14. Invalid Provisions: Should any provision of this agreement be found to be unlawful, invalid or unenforceable for any reason, such provision shall be deemed severable from the remainder of this agreement and shall not affect the validity and enforceability of the remaining provisions.
  15. Amendments to the Terms: The Organiser reserves the right to amend, supplement or revoke these Terms and Conditions of Participation in whole or in part. Participants are bound by any amendment or supplement to the published Terms and Conditions or other rules.
  16. Applicable Law and Place of Jurisdiction: This agreement is governed by Swiss law. The exclusive place of jurisdiction is Zurich (Switzerland).
